In business agreements or commercial transactions, the general presumption is that parties intended to create legal binding and to make a contract. For social, family and domestic arrangements, the general presumption is that there is no such intentions to create legal relations. A typical example of a family and domestic arrangement between a husband and his wife is the arrangement on their living expense.
