Novation of a lease is similar to assignment of a lease except that it involves the consent or agreement of a third party. For example, the Present Tenant A has 6 months of lease left and he wants to get someone to take over the remaining lease. The consent or agreement of the Landlord B must be obtained. Assuming that he was able to find a New Tenant C to take over the remaining 6 months lease, all 3 parties i.e. the Landlord B, the Present Tenant A and the New Tenant C are to sign a Novation agreement.
