Removal of easement – Property in Singapore for rent

Property in Singapore for rent – Easements can be removed:

  • By statue, if an easement has not been in use for more than 12 years, it may be cancelled by the registrar. The Land Titles Act provides that where an application is made to the Registrar and if there is evidence that the easement has not been in use for more than 12 years, the Registrar may give notice to the owner of the dominant tenement to treat the easement as abandoned.
  • By expressed release through a deed, if the owner who is the dominant tenement has no need for the easement any more. He may remove the easement through the execution of a deed.
  • By unification of the ownership of the dominant tenement and the servient tenement through a sale. The two adjoining lands are now owned by the same person.
  • By Court order if the owner, who is a servient tenement, is able to convince the Court to have the easement ended e.g. it is of no practical use any more.
