Caveatable interests – HDB resale flat for rent

HDB resale flat for rent – In order to lodge a caveat, the person lodging the caveat must have a “caveatable interest” in the land against which the caveat is lodged. Generally speaking, a caveatable interest is an interest in the land itself. Examples of caveatable interest are as follows:

  • A Buyer who has paid a deposit and exercised the Option to Purchase to buy a particular property.
  • A financial institution which has granted a mortgage to the buyer of a property
  • Lessee’s interest in a lease not exceeding 7 years.
  • Between husband and wife, for example, in a pending divorce case, if the wife wants to caveat the husband’s property, she must first obtain an injunction under the Women’s Charter. Then she would have had a caveatable interest under the LTA, which provides that a person claiming an interest in land shall include a person who has obtained an injunction in respect of an estate or interest in land.
  • Beneficiary under a trust
  • A victim of fraud, for example, an owner was cheated off the ownership of his property through fraudulent means. He can lodge a caveat in the meanwhile while taking Court actions to recover his loss.
