The Land Titles Act provides that restrictive covenants shall expire 20 years from the date of the creation of the restriction or 5 years from the date of entry of a notification on the land register (whichever is the latest) unless extended by the registered owner of the dominant land. The Land Titles Act further provides for instances when a restrictive covenant may be varied or extinguished. They are by:
(a) a variation by an instrument in the approved form by the registered owner of dominant land;
(b) release wholly or in part by an instrument in the approved form by the registered owner of dominant land;
(c) expiry term of restrictive covenants; and
(d) extinguishment or variation by order of Court. However a State covenant cannot be removed by the Court. A differential premium would be required to be paid to theSLAfor the removal of the restrictive covenant.
