There is one exception to the requirement of “consideration”, and that is a “deed”, which is a contract executed “under seal”. If the contract is a deed, then no consideration is required. Contracts are usually executed by deed or under seal if the parties intended the contracts to be binding despite the absence of consideration or if parties are doubtful whether there is consideration.
