Duty of Salesperson engaged by Sellers – HDB resale flat for rent

HDB for rent in Singapore – a) It is the duty of a salesperson engaged by sellers to explain all items in the Resale Checklist to the sellers and tick all the boxes. (Advisable to go through the Checklist as soon as the flat owners are considering to sell their flat) HDB for rent in Singapore.

c) Remind the sellers to state the address of their next housing.

d) Assist sellers who plan to buy another flat to prepare the Estimated Sale Proceeds Statement for the current flat & the Financial Plan for purchase of next flat using the Sale Proceeds Calculator and Financial Plan Calculator in the HDB InfoWEB.

e) Deposit a softcopy of the Resale Checklist and Estimated Sale Proceeds Statement and Financial Plan for the next purchase in HDB’s Resale Checklist Repository by the following day after completing the Checklist i.e. scan the documents and submit using the Repository e-Service in the HDB InfoWEB.

f) State the date of deposit of the Resale Checklist in the Resale Application Form when submitting the Resale Application to HDB. There is no need to attach a scanned copy of the Resale Checklist when submitting the Resale Application to HDB via the HDB-ResaleNet System. HDB resale flat for rent.

g) Submit the original Resale Checklist and Estimated Sale Proceeds Statement and Financial Plan for next purchase to the HDB Resale Office at the First Appointment. HDB for rent in Singapore. 

Points to Note

a) Only the Salesperson engaged by the sellers is to complete the Resale Checklist, witness the signing of the Option to Purchase / Resale Application Form and execute the Salesperson Statutory Declaration. These documents must be endorsed by the same Salesperson. HDB for rent in Singapore.

b) The Resale Application will not be accepted if the sellers granted the Option to Purchase less than seven (7) days after the Resale Checklist is completed. HDB resale flat for rent.

c) The Salesperson must ensure that the Resale Checklist is correctly completed and signed, and all documents related to the sale/purchase of the HDB flat are not back-dated or post-dated.

d) Depositing the completed Resale Checklist and supporting documents in the Resale Checklist Repository does not mean an acceptance/approval of the Resale Application. HDB reserves the right to reject or cancel the Resale Application or revoke any approval for the resale if the information provided in the Resale Checklist, Resale Application Form and supporting documents are incomplete or incorrect.

Penalties for Infringement:

In addition to other remedies, the Housing & Development Act (Chapter 129) provides that any person who makes a false statement is liable to a fine not exceeding $5,000/- or imprisonment for a term not exceeding 6 months, or both. HDB for rent in Singapore.

Under the Oaths and Declarations Act, any false statement made in a Statutory Declaration will be constituted as an offence under the Penal Code. The offence carries a penalty of up to 3 years’ imprisonment or a fine, or both.

If a salesperson is found to have made a false declaration, HDB will report the matter to the appropriate authorities.
