Property in Singapore for rent – The essentials of a lease are as follows:

  • There must be a grant of exclusive possession. The landlord must grant the tenant the exclusive possession of the property during the tenancy period. Even the landlord cannot enter the premises without the consent of the tenant. Normally a tenancy should specify under what circumstances the landlord is allowed to enter the premises by prior appointment.
  • There must be intention to create a lease. This is usually done by having both the landlord and the tenant sign a tenancy agreement.
  • The period of a lease must be certain. The tenancy agreement must clearly state the duration of the lease period and the commencement date.
  • Lease of more than 7 years (including any option to renew) must be in writing in the form of a Deed and in English (as stated in the Conveyancing and Law of Property Act) and must also be registered with the Registry of Titles.
  • Lease of 7 years or less (including any option to renew) may be in writing or oral. Such a lease should preferably be in writing even though an oral agreement for a lease coupled with part performance by the tenant will also render the lease enforceable.
  • The landlord has right of reversionary interest. At the end of the lease, the possession of the land shall be reverted back to the landlord.
