1. Professionalism, Values and Service Culture

1.1 Estate Agents should leverage on their professionalism, values and good service in their recruitment efforts. The focus in the advertisements should be on the professionalism, values and service culture of the estate agent and the advertisement can highlight the positive aspects in those terms. 1.2 Estate Agents pay to CEA the registration fees of their salespersons. Many estate agents claim such fees from their salespersons. Some estate agents may decide to pay fully or partially for CEA registration fee as well as Real Estate Salesperson (RES) course and examination fees. The estate agent can also decide on the proportion of commission sharing between the estate agent and salesperson. These decisions are business decisions that the estate agent can make and they may package them as part of the terms of the agreement between the estate agent and salesperson. However, estate agents are to refrain from advertising such freebies in their recruitment advertisements as it may attract new entrants/ salespersons that join for the wrong reasons and project a negative image of the real estate agency industry to the public – property in Singapore for rent.

1.3 Estate Agents should not place recruitment advertisements that are misleading such as claims of 100% commission, when there are various costs that are to be borne by the salesperson if he joins the estate agent.

1.4 Estate Agents should exercise judgment in recruiting persons into their estate agents. There should be an assessment by the KEO or someone authorised by him before any salesperson is recruited. Estate agents bear the responsibility to manage and supervise salespersons and hence having more salespersons carry with it added responsibilities and potential liabilities.

2. SMS and Email

2.1 The text of all recruitment advertisement via sms and email must be vetted and authorised by the KEOs as recruitment is done on behalf of the estate agent. Indiscriminate mass broadcast of recruitment messages via sms or emails are to be avoided.

2.2 In advertisement for recruitment of salespersons through sms and e-mail where a recipient has informed of his desire not to receive such advertisement, estate agents shall ensure that appropriate measures are in place to ensure that the recipient will not receive other recruitment advertisement from the same estate agent or any of its salespersons – property in Singapore for rent.

2.3 Estate agents and salespersons are reminded that they must comply with the requirements under the Spam Control Act with regards to unsolicited advertising through commercial electronic messages or SMS sent in bulk. In line with the Spam Control Act, there shall be the letters “<ADV>” with a space before the title in the subject field. If there is no subject field, the words first appearing in the message must clearly identify it as an advertisement.

2.4 All advertisements via SMS must include a mobile telephone number to which the recipient may submit an unsubscribe request by text. Where a recipient has submitted such a request, the estate agent or any of its salespersons shall not send further unsolicited advertisements.

3. Recruitment Venues not allowed

3.1 Estate agents and salespersons shall not undertake recruitment activities at certain venues e.g. carrying out recruitment activities of any kind at other estate agents’ premises or recruitment activities such as distribution of recruitment flyers at centres for RES courses or examination. Estate agents should not allow existing salespersons to approach persons undergoing courses/exam at the RES / Approved Course Provider course venue or exam venue for recruitment purposes.
